Will of John Boyd - 1818

State of South Carolina

Edgefield District

In the Name of God, Amen.

I, John Boyd, of Edgefield District in South Carolina do make and ordain this my last Will and Testament.

I recommend my Soul to God who gave it and my body I recommend to the earth.

It is my will that all my just debts be paid out of my crops that shall remain and the crip that shall be made the next ensuing year after my departure and such part of my stock and personal Estate as can be best spared, or as much thereof as shall be necessary when added to the cash I may have in hand.

I give and bequeath to my daughter Maria Boyd one third part of all my Estate real and personal.

I give and bequeath to my son Henry K. Boyd one third of all my Estate real and personal.

I give and bequeath to my son John Boyd one third part of all my Estate real and personal.

I give and bequeath to my Sister Ann Boyd to be paid to her yearly in advance as much of my estate as will when added to any part of her share of brother Robert Boyds Estate that may be in my hands as will comfortably support her during her life and supply her with necessary pocket money.

It is my will that as soon as convenient after my departure that my executors and children jointly appoint three, five or seven faithful and wise persons of tinder honestly and that after they are duly sworn to do impartial justice to each child proceed to divide all my Estate into 3 lots of shares giving each lot of land such quantity as shall make the value as near alike as the case will admit. Then the greater pay the less a sum of money to make up and balance and that they also divide and make three equal lots of all my negroes giving each lot equal number of the different ages and sex so that all my children may share as near alike as possible and also that the said persons appointed divide all my horses, cattle and other stock, household furniture tools into three equal lots or sell as my children shall mutually agree.

I appoint my brother Hezekiah Boyd my daughter Maria Boyd and my sons Henry and John Boyd to execute this my last Will and Testament voiding all other wills made by me.

Witness my hand and seal this 7th September 1818 in the presence of

A true and perfect Inventory and Appraisement of all the goods, chattels and personal Estate of John Boyd Dec'd late of Edgefield District and State of South Carolina as shown by John W. Williams and Henry K. Boyd executors of said Dec'd and appraised by us whose names are hereunto subscribed this 15th day of November 1821.

The Last Will and Testament of John Boyd

In the name of God amen, I John Boyd being in a bad state of health but of sound and sufficient mind thanks be to God for the same do make and ordain this my last Will and Testament revoking and making all others made by me null and void.

1st I will and bequeath my soul to God who gave it hoping and trusting in him for a happy and joyful resurrection.

2nd It is my Will that my body be decently buried by my executors. And with regard to such worldly estate as it has bin pleased God to bless me with it is my will that it be disposed of in the following manner 

1st my just debts be paid out of my crop and such other of my estate as my executors may think can be best spared.

2nd It is my will that so much money should be raised out of my estate as shall or may be necessary to build a good strong and sufficient brick wall around the grave yard where my parents and relations are buried with an Iron gate thereto.

3rd I give and bequeath to my cousin Wineford Williams (Over and above the distributive share of my estate hereafter named) the following named property on the plantation or tract of land lying in this District or Savannah River known by the Crow Hill tract or plantation. Also four negroes as Old Jim and wife Cloe, Old Celvey, and old Beddy.

4th I give and bequeath to the trustees or such other person as may have the superentendance there one hundred dollars for the purpose of aiding and assisting in building the contemplated Baptist Meeting house in this neighborhood between the Creek and River provided the same should be in progression within two years after my decease also ten dollars a year to the Rev. R. Careson as long as he continues to preach in this neighborhood.

5th I give and bequeath to my nephew John Henry Williams the son of my sister Mariah Williams one third part of my Estate which is not otherways herein disposed of after deducting the two thousand dollars left him by brother Henry K. Boyd as expressed in his will and which is hereafter provided for provided he the said John should live to arrive to the age of Twenty one years the amount of one third to be ascertained by appraisement after deducting as above from the general neat amount of said estate and paid over to him in property immediately on his arriving to the age of Twenty one years until which time my executors is to keep said property in their own hands and use it in such a way as they may think most advantageous to said minor but should the said Jho die before he arrives to the age of Twenty one years it is my Will that immediately after his death the said one third with the profits arising therefrom and be disposed of in the same way as the other two thirds of my estate is hereafter directed. It is also my will that the legacy left said John H. Williams by the last Will of my brother Henry K. Boyd of Two Thousand dollars under certain restrictions therein specified (as) the whole amount of the estate of my said brother being vested in me by his last Will until the said J. H. Williams arrives to the age of Twenty one years, then and in that case he is to receive Two Thousand dollars of my brothers estate. It is my Will therefore that those two thousand dollars of my estate be and remain in the hands of my executors until my said nephew arrives to said age and then paid by them to him but in case the said J. H. should die before he arrives to the age of twenty one then the above named two thousand dollars agreeable to said will remaining unalterably mine, must revert and be divided between my hereafter named relations.

6th I Will and bequeath the remaining two thirds of all my Estate real and personal to be equally divided among my several relations share and share alike (Viz) My Uncle Hezekiah A. Boyd, my Aunt Emma Ann his wife and their two daughters Francis Martha and Eusebia Elvira Boyd and my aunt Martha Collier also her four children, Hidgdon Boursom, William P. Boursom, Joseph Collier and Ann Collier also my cousin Wineford Williams and her three children Osburn, Patsy and Elizabeth Williams also my cousin John Boyd son of James Boyd. It is also my Will that is my executors think it most advisable in order to effect a division of said estate to sell my real estate or any part of my personal property they are at liberty to do so, and must divide the money my relations as above named.

7th And lastly, I do appoint my uncle Hezekiah A. Boyd and Doctor John W. Williams Executors to this my last Will and Testament, investing them with full power and authority to execute the same.
