In the matter of proving the Last Will and Testament of
James S Boyd deceased as a Will of Real & personal Estate
At a Surrogate’s Court held at the Orange Hotel in Newburgh in and for the County of Orange on the Eleventh day of November in the year one thousand eight hundred and forty__ Present George M Grier Surrogate On reading & filing the Petition and application of James Waugh & Robert Blake Executors named in the Last Will and Testament of the said James S Boyd late of the Town of New Windsor in the County of Orange deceased. for the proof of said Will as a Will of Real and personal Estate (by which petition it appears that Elizabeth Finly & James Finly are infants, and the
next of kin of said deceased upon reading & filing the consent of William Wright of the Town of Newburgh in said County It is Ordered that the said William Wright be and he is hereby appointed the Special Guardian for the said Infants for the sole purpose of appearing for and taking care of the Interests of said Infants in the proceedings to be had in proving the said last Will and Testaments of said deceased, both as a Will of Real and personal Estate. And it is Ordered that the follow-
ing Citation issue Viz:

State aforesaid Elliott Thompson Mary his Wife of the County of Ulster in the State aforesaid Town unknown Nathaniel Boyd of the City of New York Charles Boyd of the State of Illinois County & Town unknown_the next of kin of James S Boyd late of the town of New Windsor in the County of Orange deceased. Greeting: You are hereby cited to be and appear before the Surrogate of the County of Orange at the Orange Hotel in Newburgh in said County on the thirteenth day of January next at ten O’lock in the forenoon
of that day, to attend the probate of a certain instrument in writing, purporting to be the Last Will and Testament of said deceased, bearing date the third day of December in the year of our Lord one thousand eight hundred and thirty three on the application of James Waugh & Robert Blake claiming to be the Executors thereof_Which said Will relates to both real & personal Estate_
In Testimony Whereof, we have caused the seal of Office of our said Surrogate of the County of Orange to be hereunto affixed. Witness, George McGrier, Surrogate of the said County, at Goshen, in said County, the twelfth day of November in the year one thousand Eight hundred and forty_

Appeared and prayed that the said Will be admitted to probate and Exhibited the following proof Orange County ss: James Waugh of said County being duly sworn says that
he served Copies of the within Citation upon the within named Samuel Finley Elizabeth Finley John Boyd Robert W Boyd Martha Homan Jane Wear John Alexander Hannah Alexander Elliott Thompson & Mary Thompson at least fifteen days previous to the 13th day of January 1841 [signed] James Waugh

Orange County ss: Robert Blake of said County being duly sworn says that he served Copies of the within Citation upon Nathaniel Boyd at least fifteen days previous to the thirteenth day of January 1841 by leaving him a copy & at the same time showing him the within Original with the seal [signed] Robert Blake

State of New York City & County of Albany ss. EM Graves, of the City of Albany, being duly sworn, says that he is foreman in the Office of the Albany Evening Journal, the paper published
by the Printer to the State, and that the notice, of which the annexed is a printed Copy, has been regularly published in said Albany Evening Journal Once in each week for six weeks successively commencing on the twentieth day of November last past.

Testament of James S. Boyd deceased, State of New York,
Orange County, - ss. James Belknap, David W Bate, James Waugh, of the Town of Newburgh in said County, being by the Surrogate of the County of Orange duly sworn & Examined depose and say & each for himself says that he was well acquainted with James S. Boyd late of the Town of New Windsor in said County, deceased And the deponent James Belknap further says that he was present as a Witness, and did see the said James S Boyd deceased subscribe at the end thereof the instrument now produced and shown to the deponent purport ing to be the Last Will and Testament of the said James S. Boyd deceased bearing date the third day of December in the year One thousand eight hundred and thirty three: That such subscription was made by the said Testator in the presence of this deponent and Edmund Sanxay since deceased subscribing witnesses to said Will: That the said testator at the same time declared the instrument so subscribed by him to be his last Will and Testament, whereupon this deponent & Edmund Sanxay signed their names at the end of the Will, at the request of the said testator; And that the said Testator at the time of executing & publishing the said Last Will & Testament, was of full age sound mind and memory, and not under any restraint. And the deponent David W Bate for himself further says that he drew-up said Will at the request of the said Testator and under his special direction & instruction and this deponent
further says that after said Will was executed as aforesaid he enclosed the said Will in an Envelope sealed up and inscribed there on “Last Will of James S. Boyd” And the deponent James Waugh for himself further says that he received said Will of the said Testator for safe keeping & kept the same in his possession until he handed the same to the Surrogate of the County of Orange & made application for the proof thereof. And the deponents James Belknap and James Waugh further say that the Will now produced & shown to them respectively is the same in all respects as When executed as aforesaid_

I James S Boyd of the town of New Windsor being of sound and disposing mind, do this third day of December in the year of our Lord One thousand eight hundred and thirty three make this my last Will and testament disposing of all my real & personal Estate as follows _
1st I give, bequeath and devise to my beloved Wife Sarah the use and enjoyment during her natural life, of all my property of every nature, kind and description whereof I shall die possessed after the
payment of my just debts and funeral expenses.


2nd After the death of my said Wife, or at my decease in case my wife shall died before me; I give, devise, and bequeath all my property of every nature and kind to my daughters Martha Homan, Widow, Jane Wear wife of John Wear, Mary Thompson wife of Elliott Thompson & Hannah Alexander wife of John Alexander, absolutely and forever equally to be divided between them share and share alike, and in case either of them should then be dead I direct that her share shall belong to her children equally, if more than one, to be divided between them, and if either of my said daughters shall then be dead without issue, then her share shall go to such of my said daughters as shall be then living, and to the children of such, if any as shall then be dead leaving children, and in such case the children to take as their mother would had she been living. 3rd I hereby revoke all former Wills by me made and appoint my good friends James Waugh and Robert Blake
Executors of this my Last Will and I do hereby authorize and empower my said Executors or the survivor of them, at any time during the life of my wife if they or the survivor of them shall think it best so to do to sell all my Real estate absolutely, and if such sale shall be made, out of the proceeds thereof to pay such debts as I may justly owe at the time of my death, and remaining then unpaid, and the remainder to vest or loan out in some safe manner, and to apply the income thereof to my said wife’s support, and at her death to pay and distribute said remainder to and among my said
daughters, according to the provisions of this my will above made in manner aforesaid. In witness whereof I have hereto set my hand
and seal the day and year above written_

Will: Robert Boyd

New Windsor, Ulster County, New York

02 May 1781, Robert Boyd, yeoman, Precinct of New Windsor, Ulster County, New York, to my wife Jennet, the use of my household and kitchen furniture of every kind during her widowhood, with the use of all my estate during the time aforesaid; and at her death, the part that remains shall be divided as follows: to my son Robert, five shillings; to my granddaughter, Jennet Harris, eldest daughter of my son-in-law, George Harris, 50; Also all my household and kitchen furniture after my death and death of my wife; all the rest of estate that remains after my decease and that of my wife to be divided among my grandchildren, as follows: John Boyd, Samuel Boyd, Jennet Boyd, Agnes and Robert Boyd, children of my son Robert, together with Elizabeth, Agnes, Jane, Elinor, and Susana, children of my son-in-law, George Harris; Mabel, Jennet, and David, children of my son-in-law, Robert Andrews; to be equally divided among them, and when they shall each arrive at legal age. In case my granddaughter, Jennet Harris, die before my wife, her legacy to be divided among the children of my sons-in-law, George Harris and Robert Andrews, or the survivor of them, share and share alike. I appoint William Scott (cooper), of New Windsor, and Thomas Moffat, Esq., of Orange County, executors. Witnesses, John Herron, James Boyd, Hugh Turner, yeoman. Proved, 18 April 1786.

From The New York Historical Society Collections, this 1896 volume features abstracts of wills on file in the Surrogates Office, City of New York, from 1754-1760.

Page 219.--In the name of God, Amen. I, Samuel Boyd, of New York, taylor,
being of sound mind. "I leave to my brother, Robert Boyd, a lot of land in Ulster County, being 151 acres, commonly called by the name of Boyd's Hall. My sister, Janet Boyd, is to have a living on the place during her widowhood, till the youngest child be of age." I leave to my brother, Nathaniel Boyd, a lot of land in Orange County, being 56 acres, commonly called by the name of Boyd's Grove, And my sister, Margaret Boyd, is to have a living on it during her widowhood, or till the youngest child is of age, I also leave him 85. I leave to my brother, James Boyd, a lot of land, 100 acres, in Ulster County, commonly called Boyd's Folly, and my sister, Mary Boyd, is to have a living on it during her widowhood, or till the youngest child is of age. I leave to my sister, Mary Waugh, 100 acres of land in Ulster County, called by the name of Boyd's Promise, and I also further order that if her male heirs should wear out, then that 100 acres shall return to my brother, Nathaniel Boyd. I leave to my brother David and his children in Ireland 100, and 20 now in the hands of Mr. Jesse Craig. I leave to my honored father [not named] 3 pounds Stirling yearly during his life. I leave to my cousin, Robert Boyd, blacksmith, 5, and to every brother's son that is named after me 10. "All the rest to my brothers and sisters and their children." I make Abraham Van Gelder, cordwainer, Robert Boyd, blacksmith, James Boyd, farmer, and Nathaniel Boyd, farmer, executors. Dated February 7, 1757. Witnesses, Abraham Van Gelder, Edward Snape, Andrew Sloane. Proved, April 7,1757.

Page 164.--In the name of God, Amen. I, WILLIAM LE CONTE, of New Rochelle, being advanced in years, yet of sound mind. My executors are to pay all just debts and funeral charges. I leave to my daughter Anne 50. I leave to my 2 grand sons, William and Richard Bayley, 20 and all my clothing, and my gun, sword, and watch, and I also leave 20 to their mother, Susanah Bayley, my daughter. My executors are to sell all real estate. Of the money, 1/3 is to be put at interest for my daughter Susanah, wife of William Bayley, and the principal is to be paid to her after his decease, and the rest to my 2 daughters, Mary Anne, wife of John BOYD and Anne Le Conte. I make my daughter Anne and my friend, Samuel Gillett, executors. Dated October 9, 1758. Witnesses, Joseph Antoine, Elie Guion, Esaie Guion. Proved, December 13, 1758.

NEW-YORK, by the Grace of GOD, FREE and INDEPENDENT,

TO John Boyd a son, and John Morrison a friend of Nathaniel Boyd late of the Town of
New Windsor in the County of Orange deceased.


Send Greeting:

WHEREAS the said Nathaniel Boyd –
as is alledged, lately died intestate, having whilst living, and at the time of his Death, Goods, Chattels, or Credits, within this State, by means whereof, the ordering and grating Administration of all and singular the said goods Chattels and Credits ; and also the auditing, allowing and final discharging the account thereof doth appertain unto us ; and we being desirous that the Goods, Chattels and Credits of the said deceased, may be well and faithfully administered, applied, and disposed of, do grant unto you, the said John Boyd and John Morrison Administrators of all and singular the Goods, Chattels and Credits which were of the said Nathaniel Boyd IN TESTIMONY whereof we have caused the Seal of Office of our said Surrogate to be hereunto affixed. WITNESS, James Everett Esquire, Surrogate of said County, at Goshen the twenty eighth Day of December in the Year of our Lord One Thousand Eight Hundred and seven.
