issued 19th August, 1767. In 1764 Alexander Boyd mortgaged land and
slaves to Alexander Baine. orator. Alexander Boyd died intestate and
administration was granted to ANDREW BOYD, his brother and heir-at-law.
Land lay on branch of Roanoke River called Staunton River.

ROBERT
BOYD, only son and heir of ROBERT BOYD, late of this County, who died
intestate in 1752, possessed of land on Middle River. Widow ELEANOR
(mother of orator) qualified administratrix. Orator and his sister were
the only surviving children of Robert, Sr., and both infants. When
orator became 14 years old he chose Francis Gardner (defendant) as his
guardian, who qualified in 1761. Bill for accounting.

merchant, in Fredericksburg: Alexanderia, 6th September, 1764. Mr. Henry
Mitchell. Sir:--The last time I saw Mr. McCaul he told me he was just
about leaving the Country, and he having a note of hand of mine
amounting to £96,2, 6, which I could not then discharge any part of,
and as you have the direction of his affairs, you'll please receive
under cover £10, 15, 0, and two orders, one on Mr. James Mercer for £2,
18, 6, due me by his brother, the Colonel, and another, £20, 0, 0,
which I'll receive at the next sitting of the Assembly, it being for two
months' pay of Person Cotuners, that was attached, for which I never
received. You have likewise another order for £22, 10, 0, and interest,
for some years due me from Squire Brown, which Mr. Truble included in
with a bond of his, and he promised to pay it at the October Court, and
make no doubt of your getting it then, or soon after. The balance of £4,
2, 0,you'll receive (if not already paid) from Mr. William Scott, which
he owed me. As Mr. McCaul's account against me is for medics. and
billiards, he desired I might not put myself to any kind of
inconvenience till it suited me. You may depend, however, that I'll
endeavor to contrive the balance as soon as lies in my power. My bad
fortune in that way has been of great prejudice to me. When it is
convenient your acknowledging the receipt of this by way of Staunton-
-and direct for me--merchant at Fort Lewis, in Augusta County,

Sir: I humbly beg your advice in a matter of consequence, and that is
one of my neighbors named ROBERT BOYD has abused my wife and my
mother-in- law in a most scandalous manner and publicly reported that
they were both perjured. I shall beg, if you be pleased, to take the
affair in hands and execute as far as the law directs in such a case,
and beg that you will let me have an answer by Mr. Smith, the Sheriff,
for I shall be down the fall Court, and you shall be paid to your full

page 500 - McClenachan vs. Calmer.--I promise to pay, &c., unto
John McClenachan, &c., £9, 16, 7, Virginia currency, &c. 29th
December, 1761. (Signed) D. Calmer. Test: Alex, Love. This day came the
plaintiff, by his attorney, and the defendant being called and not
appearing, ALEXANDER BOYD, gent., a garnishee in this cause, appeared
and on oath deciared that at the time of serving this attachment in his
hands there was due from the Country to the defendant, as Chaplain of
the Virginia Regiment,two months' pay, amounting to £20, but that on
settling his accounts with the Commissioners appointed for that purpose
he was ordered not to pay it, whereupon the plaintiff produced the
defendant's note of hand for £9, 16, 7. Judgment is therefore granted
the plaintiff versus the said defendant for the same and costs. And it
is ordered that the aforesaid sum of £20 in the hands of the garnishec,
BOYD, be condemned, and it is further ordered that the Sheriff sell (one
sword and see particulars) in the hands of Robt. McClenachan, a
garnishee formerly sworn in this cause, who also made oath that the
defendant was indebted to him £8, 10, 0, and that after paying the said
Robt. McClenachan his debt aforesaid he pay the remainder, if any, to
the plaintiff in part satisfaction of his judgment and costs, and that
he have executed versus the garnishee, ALEX. BOYD, for the residue.

page 520 - We, the undernamed jurors for the Commonwealth of
Virginia, present that Alex. Sproul did, on the 18th day of January
last, in the County aforesaid, unlawfully make a forcible entry into the
house and possession of George Almarode, with arms, of which he was then
possessed, and does continue to keep out the said Almarode, to his hurt
and damage. In witness whereof the undernamed jurors have hereunto set

Mitchel,
Lieutenants, show that James Shields beat Ensign Wilson by two
votes--15th December, 1783. Thomas and Robert Tate, Windel Grove,and
George Shoultz write under date of December 12, 1783, that they belong
to the Company formerly Captain Tate's, and being abroad and so unable
to vote at the last election for Captain, now desire Ensign Wilson
should be promoted.

Hartigan vs. THOMAS BOYD's administrator--Bond between
plaintiff and defendant, 1797.Writ endorsed. T. BOYD is dead; suit
wished in name of his administrator. George Reed is administrator of
BOYD, who died intestate; people of name of White, in Kentucky, are his
heirs. BOYD was related to the Whites through his mother.

vs. Samuel Doak--O. S. 40; N. S. 14--Bill 16th June, 1802. In 1770
Andrew Little made a settlement on waters of Reed Creek, then in
Fincastle, now Wythe, and a short time afterwards transferred it to John
Riley, who sold to orator. In 1775 Samuel Doak, from a military warrant
under the King of Great Britain's proclamation, had a survey made
including above settlement. The warrant to Samuel was dated 1773, and
under the proclamation of 1763. Samuel Doak went to live in North
Carolina (now Tennessee) about 1789, and has never returned. Answer
states that in 1768 Robert Doak, for and on behalf of Samuel Doak, sowed
some turnips on the land but made no actual settlement. In
1770 Jacob Young made an improvement on the same tract but removed to
Holstein and conveyed his claim to Samuel. In 1771 Samuel built a cabin
and afterwards Andrew Little built a cabin but never lived in it. GEORGE
BOYD, of Stuart County, Tenn., deposes 3d December, 1804.

Mathews--O. S. 152; N. S. 53--Deed dated 21st March,
1796, by William Anderson and Margaret, his wife, of Fayette County,
Ky., to ANDREW BOYD of Wythe County, conveys tract in Botetourt County.
Recorded in Botetourt County, February-June, 1797. Recorded in Fayette
County, April, 1796. On 10th July, 1766, John Smith made an entry for
400 acres at mouth of Purgatory Creek on James River, including town of
Pattonsburg, which in 1770 he sold to Margaret Buchanan, widow of John
Buchanan.

Moore--O. S. 168; N. S. 59--Bill, June, 1808.
Complainants are, viz: John, Nathaniel, James, William White, Margaret
(White), wife of James McFarland, Rebecca (White), wife of William
McFarland, Mary (White), wife of Robert Snodgrass, David Greenlee and
his children (infants), heir of their mother Jane, who was Jane White,
all being heirs and legal representatives of John White, who was only
heir-at-law and legal representative of THOMAS BOYD, who was son of
ANDREW BOYD, who died many years ago, leaving a tract in Augusta County,
240 acres. ANDREW died testate in Augusta, devising to his wife and
sons, THOMAS and JOHN. Andrew's widow died intestate and her part
descended to THOMAS, the eldest son. After Andrew's death, a patent
issued in ANDREW's name for an entry of his for 115 acres, but some one
struck out ANDREW and inserted JOHN. JOHN died testate, without issue,
devising his lands to his wife, ELIZABETH, for her life, with reversion
to her son, JOHN VARNUM. Then THOMAS BOYD died intestate, leaving
complainants his heirs. But ELIZABETH BOYD and William Moore, who bought
claim of Varnum, set up an adverse claim. Answer says ANDREW BOYD died
1750. A patent for the 115 acres issued in 1759 in name of JOHN, when he
was not more than 12 or 15 years old. ANDREW BOYD's will dated 26th
February, 1749, proved in Augusta 22d May, 1750, to cousin, John White,
if he came here to live. Wife, Rebecca.

Eyre--O. S. 206; N. S. 73--Answer filed 1804, says about 40 years ago
Robert Eyre married Ann Price, daughter of John Price, who lived in
Chester County, Pennsylvania, and about eleven years thereafter removed
to Virginia. On 12th September, 1770, John Price made his will. Elisha
and Samuel Price were brother and uncle of Ann. Robert had (at least)
two children, John and Hanna; also sons, Robert and Adam. Will of John
Price of Lower Chichester, Chester County, Pennsylvania: Wife Elizabeth;
daughter Ann, wife of Robert Eyre; son Samuel; daughter Hannah Price;
daughter Sarah Price, infant; son John, infant; daughter Elizabeth;
sister Sarah Price. Dated 12th December, 1770. Recorded in West Chester.
Deed dated 7th April, 1796, between Robert Eyre of Norbon Parish,
Berkeley County, yeoman, to Elisha Price of Chester Borough,
County of Delaware, Pennsylvania, and Samuel Price of Lower Chichester,
Pennsylvania, and Ann Eyre, wife of Robert, and Robert Eyre, Jr. 250
acres in Berkeley. Deed dated 18th April, 1796, by Robert Eyre to
WILLIAM BOYD, 277 acres on Mill Creek in Berkeley, conveyed by grantee
to grantor on same date. Proved in Berkeley 25th April, 1796. Deed dated
23d June, 1800, by Richard Ridgway, Robert Eyre and Ann and James
Stephenson. Mortgage conveys part of 1,000 acres patented to Morgan
Morgan 12th November, 1735, and conveyed by Morgan to Zackwell Morgan in
1761, and to Robert Rutherford in 1768, to James Seaton in 1769, to
Robert Eyre in 1777. Recorded in Berkeley 24th June, 1800. Deed 28th

Campbell--O. S. 214; N. S. 75--Bill, 8th June, 1807. Orator is John
Drake of Kentucky. John Buchanan of Augusta died testate, leaving
remainder to three younger daughters or the survivors of them come of
age. Orator's father, Joseph Drake, in 1773 married Margaret, one of the
daughters of John Buchanan. Prior to 1778 Joseph moved to Kentucky,
where in that year he was killed by the Indians, leaving orator infant
of very tender years. Margaret afterwards married ---- Jones. Josiah
Ramsey deposes, 1809, that the Indians were troublesome in Washington
County from 1776 to 1779. Col. Robert Sawyers
deposes at Fort Chesel in Wythe County, 1808. He was present at marriage
of Joseph Drake and Peggy Buchanan. John Buchanan, son of Col. John
Buchanan, deceased, grandfather of orator, was second lieutenant in same
company with deponent in Seventh Regiment of Virginia line on
Continental Establishment and in spring of 1777 was detached under
command of then Col. Morgan from Middle Brook, New Jersey, against
Burgoyne, and was killed at battle of Saratoga. John Floyd sailed in a
privateer against the enemy in the fall of 1776, and returned in 1779.
Widow of Col. John Buchanan, deceased, married William Anderson shortly
after marriage of Joseph Drake and some time before the death of her son
John. Patent 23d December, 1779, to Wm. Campbell and Wm. Preston,
executors of John Buchanan, deceased, assignee of James Patton, deceased,
by survey 1749-50, 1,150 acres part of order of Council to James Patton
et al on Sinking Creek waters of Middle Branch of Indian River. MARY
BOYD, wife of ANDREW BOYD and daughter of Col. John BUCHANAN, deposes in
Wythe, 18th November, 1809. Col. William Preston died in 1784. Anna
Buchanan married Ephraim Drake in Kentucky. She was born 28th November,
1765. Joseph Drake and Margaret Buchanan were married in March, 1773.

Madison, John Preston, Francis Preston, James McDowell and Sarah, his
wife, William Preston, Nathaniel Hart and Susannah, his wife, James P.
Preston, John Lewis and Marah, his wife, and Letitia, Thomas and Peggy
Preston, infants, by John Preston, their guardian; which said John,
Francis, Elizabeth, Sarah, William, Susannah P., James P., Mary, Letitia,
Thomas and Peggy are children of William Preston, deceased, Col. James
Dysart, aged 65 years, deposes in Lincoln County, 22d June, 1808. In
1776 on account of Indians, Joseph Drake moved to New River near his
father's. In 1778 cr 1777 he moved to Kentucky. In 1769
deponent and Joseph made a hunting tour of seven months in Kentucky;
again in 1771 a tour of nine months, and in 1772 a tour of eleven
months. Deponent and Col. Buchanan came from same neighborhood in
Ireland and were remotely connected. When Joseph moved to Kentucky, Anna
Buchanan was about 10 or 12 years old. John Campbell deposes in
Washington County, 18th March, 1808, he is 66 years old. James Buchanan,
power of attorney, dated Bourbon County, Virginia, 26th June, 1787. Col.
Wm. Donalson deposes in Davidson County, Tennessee, 5th July, 1808, is
48 years old. Deed 8th July, 1788, by Thomas Madison, attorney for James
Buchanan, son and heir to John Buchanan, deceased, to John Campbell,
1,150 acres in Washington County on Indian, now called Holstein, River.
Recorded in Washington County. James Newell deposes in Wythe County, was
present at marriage of Joseph Drake. Deponent and Joseph were in 1774 on
the Shawnese expedition together. Col. Robert Craig deposes at own house
in Knox County, Kentucky, 18th June, 1808. James Buchanan deposes 21st
March, 1799, at house of Patton Anderson in Fayette County, Kentucky.
James Thompson deposes in Abingdon, 19th October,1809, was present at
Joseph Drake's marriage; none of Margaret's people was present except
William Buchanan. They were married at the town house about 17 miles
east of Abingdon; there were present, viz: Ephraim Drake, William
Anderson, Widow Cartey, Peggy Campbell, Anna Campbell et al. Ephraim
Drake deposes in Bedford County, Tennessee, 26th June, 1809. Joseph and
Margaret were married agreeable to the established custom by Mr. Wolsey,
a Baptist preacher; her elder brothers were present. Col. Mathew
Willoughby, aged 59, deposes 26th March, 1813, in Washington County,
Virginia. John Young, son of Jacob, was notorious for bonestealing; also
Daniel Young, son of Jacob. Deed 23d October, 1810, by Margaret Jones,
now living in Franklin County, Tennessee, widow and relict of William
Jones, deceased, also of Joseph Drake, to John Drake, of Bedford County,
Tennessee. Recorded in Washington County, July, 1811. John Campbell
answers. When Joseph moved to Kentucky, Margaret had three brothers, viz:
William, killed in Kentucky; John, killed at Saratoga in 1777; James,
now living in Kentucky. Margaret, widow of Col. Jno. Buchanan, married
--- Anderson and was living with him in Botetourt in 1777. John
Buchanan's will of Augusta County. Sons, James, William and John; wife,
---, daughter of Col. James Patton; daughter, MARY BOYD; three younger
daughters; nephew, William Campbell.

Vernum--O. S. 375; N. S. 137--Bill by William Vernum, that on 29th
August, 1797, John Vernum, orator's brother, contracted with orator to
build a house for orator on a lot in Greensville, but John shortly after
removed to Kentucky, but before removing John sold to William Moore, of
Rockbridge, all his interest in land in Augusta devised to him by JOHN
BOYD. JOHN died in Kentucky, and administration was granted to John
Hawkins and Elizabeth Vernum, now Elizabeth Foster. Patented 1759 to
